Landlord or third party declaration for Housing Benefit
We are carrying out a review of the documentation we hold regarding landlord/third party declaration forms.
Declaration
In order to continue receiving your tenant's Housing Benefit payment directly into your bank or building society account, you must complete the declaration.
This will confirm that you are fully aware of the obligation you are under to repay any overpaid Housing Benefit to us.
Your liability
In accordance with Regulation 101(1) and 88(1) of the Housing Benefit Regulation 2006 (if your tenant has attained the qualifying age for state pension credit then this is in accordance with Regulation 82(1) and 69(1) of the Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006), irrespective of whether you have signed the declaration:
- You are liable to repay Richmond Council any Housing Benefit overpaid to you in respect of your tenants
- You must inform the Benefits service of any change in circumstances that may affect the tenant's entitlement to Housing Benefit e.g. termination of tenancy, death, change in rent etc.
