Councillor Chappell and Roberts declared personal interests in this item by virtue of knowing the applicant, but had not formed a view on it.
10/0612/FUL – AIR SEA HOUSE, THIRD CROSS ROAD, TWICKENHAM
Councillor Cardy declared a personal and prejudicial interest in this item by virtue of being a Council nominee to the board of Richmond Housing Partnership, which is currently merging with another Housing Association which might possibly be involved in this application. He undertook to withdraw from the room for the duration of the item.

Councillor Coombs declared that as he was speaking on behalf of residents he had already formed a view and was predetermined on this application. He undertook to withdraw from the Committee for this item and to speak as an Interested Councillor. |

10/0593/COU - RAILWAY TAVERN, 91 HIGH STREET, HAMPTON WICK (Mrs H Dutton-Walker) Conversion from public house to single family dwelling.
Officer’s recommendation: REFUSAL
Minutes: The Development Control Officer made the following amendments to the report:
Page 3 - In paragraph 11 the sentence ‘No indication of the asking price and how this differed over the marketing period is shown’ should be replaced by ‘No indication of how the asking price differed over the marketing period is shown.’
The Committee heard representations from Mr Austin, Mr Correia, Mrs Dutton-Waller, Mr Smith, Mr Sutcliffe and Mr Waller.
The Committee RESOLVED that the application be REFUSED for the reasons set out in the officer's report and the additional policy CCE15 on the basis of insufficient marketing evidence having been provided to justify the loss of the pub/alternative commercial/entertainment uses – the council is expected to provide a reasonable number of small units appropriate to the site.

10/0612/FUL - AIR SEA HOUSE, THIRD CROSS ROAD, TWICKENHAM (KHL Twickenham Ltd) Demolition Of The Existing Vacant Warehouse Buildings And Construction Of A Residential Development Of 53 Residential Units Comprising Of 5 Houses And 48 Flats With Associated Parking, Landscaping And Other Works.
Officer’s recommendation: PERMISSION, subject to completion of a section 106 agreement
Minutes: The Development Control Officer presented the item and reported the receipt of the following correspondence:
1. DVD received from Colleen Seagers (18 Trafalgar Road) showing bat activity among trees within rear gardens to Trafalgar Road house close to site boundary

Late letter received from Mr Cheetham, 22 Third Cross Road objecting as
follows:
· Traffic generation - particularly parking problems and safety concerns due to the proximity of Trafalgar School. Building an Additional 53 properties can only increase the amount of traffic on Third cross road.
· Effect on Trafalgar Road Conservation Area
· Layout and density of building is excessive for this site.
· Insufficient parking for the number of properties - its difficult enough to find parking on Third Cross Road already
· Road Access - there will be limited access from Third cross road to this entire development. The street is already in chaos at peak times with school traffic. With only single lane access from the Staines Road end and no defined passing places I really can’t see how this application could be approved. It takes several attempts to navigate Third Cross Road during peak times as it currently stands.
The Committee heard representations from Mr Bellinger, Mr Coles, Mr Hansford, Mr Mahon, Mr Mainwaring, Mr Rogers, and Councillor Allen who spoke as an interested councillor.

Erection of a detached two storey domestic building for the provision of special needs housing (C2 use class) together with the provision of two off-street car parking spaces, a turning area and access off Percy Road.
Officer’s recommendation: PERMISSION, subject to completion of a S106 agreement
Minutes: The Development Control Officer presented the item and made the following amendments to the report:

· Delete ‘102 received on 9 February’ and delete ‘101a and 102a received on 11 June 2010’ replace latter with ‘101a, 102a and 103a received on 22 July 2010’
The Development Control Officer presented the item and reported the receipt of the following correspondence:
· Letter from occupant of 20 Jubilee Avenue sending apologies and explaining why he could not attend the meeting. Letter also reiterates his opposition to the proposal on the grounds of loss of a green site, increased pollution and congestion.
The Committee heard representations from Mr Bielanski, Mr Nicholas, Mr Panesar, Mr Winter and Councillor Allen who spoke as am interested councillor.
The Committee RESOLVED that the application be APPROVED, subject to the completion of a Section 106 agreement, subject to the conditions and informatives set out in the Officer’s report and the following replacement condition (NS04) and additional informative:
Condition NS04 The premises shall be used only as special needs housing (Use Class C2) and for no other purpose within Use Class C2 as specified in the schedule to the Town and Country Planning (Use Classes) Order 1987, or in any provision revoking or re-enacting that order, or as a single family dwelling (Use Class C3). REASON: An alternative use within C2 Use Class would need reassessment in relation to its impact on amenity, transport and other relevant aspect.
Informative The applicant is advised that details submitted pursuant to condition LT09 shall include scaled drawings and other information for new lighting along the site access road and footpaths and new boundary fencing, the height of which should be firstly agreed with surrounding local residents.

Officer’s recommendation: PERMISSION Minutes: The Development Control Officer made the following amendments to the report:

· Para 22, 7th line, replace north- west with south-west
· Para 11, pg 39, insert at end
All bedroom sizes meet the recommended 12m2 in accordance with the guidelines set out in the SPD. Although the kitchen/living areas fail to meet the recommended 22m2, the plans indicate that the relevant pieces of furniture can be accommodated within these areas.
The Committee heard representations from Mr Jassal and Miss Khatani.

Committee RESOLVED:

That the recommendation of the Planning Officer be NOT adopted 2. That the application be REFUSED for the following reason: The proposed units by reason of inadequate floor space provision would fail to provide a satisfactory form of accommodation that meets the modern day living requirements of any future occupants and is therefore contrary to policies BLT13 and HSG 13 of the London Borough of Richmond upon Thames Unitary Development Plan: First Review 2005, policy CP14 of the adopted Core Strategy 2009 and Supplementary Planning Document: Residential Design Standards.
