Planning Enforcement Notices
Enforcement Notices are legal charges on the land or property, served at the discretion of the Council as Local Planning Authority. An enforcement notice can require the cessation or continuation subject to conditions of an unlawful use of land and/or the removal or modification of buildings or structures that do not have planning permission.
An enforcement notice must be served on all persons who have a legal interest in the land. The notice must set out in precise terms the steps required to comply with the notice and the period of time in which compliance with the notice must take place.
Any person on whom the Notice was served has a right of appeal to the Planning Inspectorate. Appeals must reach the Inspectorate before the date the Notice takes effect One of the grounds of appeal is that the enforcement notice was not served on every person with a legal interest in the land.
