CONSIDERATION OF ANY ALLEGATIONS THAT A MEMBER OF THE COUNCIL HAS BREACHED THE CODE OF CONDUCT The Committee will assess any allegations that a member of the Authority has failed, or may have failed, to comply with the Code of Conduct and either:
i. refer the allegation to the Monitoring Officer, with aninstruction that he arrange a formal investigation of the allegation, or direct that he arrange training, conciliation or such appropriate alternative steps as permitted by Regulations; ii. refer the allegation to the Standards Board for England; iii. decide that no action should be taken in respect of the allegation; or iv. consider that the matters raised are not within the jurisdiction of the Sub-Committee
Any complaints received by the Monitoring Officer to be circulated separately.

COMPLAINT 1 Minutes: A complaint had been received alleging that various Cabinet Members had breached the Members’ Code of Conduct by failing to declare interests and approaching an item for decision in a pre-determined manner.
(1) That no action be taken on this complaint.
REASON: The evidence provided was insufficient and lacked detail and corroboration.

COMPLAINT 2 Minutes: A complaint had been received alleging that Ward Councillors had breached the Members’ Code of Conduct by their behaviour at an Area Consultation Meeting.
(1) That no action be taken on this complaint.
REASON: The Sub-Committee did not consider that there had been a breach of the Members’ Code of Conduct.

COMPLAINT 3 Minutes: A complaint had been received alleging that a Councillor had breached the Members’ Code of Conduct by failing to treat the complainant with respect.
(1) That no action be taken on this complaint.
REASON: The Sub-Committee did not consider that there had been a breach of the Members’ Code of Conduct.

INVESTIGATION BY DEPUTY MONITORING OFFICER To report the result of an investigation by the Deputy Monitoring Officer regarding an alleged breach of the Members’ Code of Conduct (circulated separately). Minutes: Further to Minute 3 of the Standards Review Sub-Committee held on 19 February 2009, the Sub-Committee considered the report of the Deputy Monitoring Officer (DMO) regarding an alleged breach of the Members’ Code of Conduct.
The DMO’s finding was that there had not been a breach of the Members’ Code of Conduct.
(1) That the Deputy Monitoring Officer’s finding that there had been no breach of the Members’ Code of Conduct be accepted and no further action be taken.
