CONSIDERATION OF ANY ALLEGATIONS THAT A MEMBER OF THE COUNCIL HAS BREACHED THE CODE OF CONDUCT The Committee will assess any allegations that a member of the Authority has failed, or may have failed, to comply with the Code of Conduct and either:
i. refer the allegation to the Monitoring Officer, with aninstruction that he arrange a formal investigation of the allegation, or direct that he arrange training, conciliation or such appropriate alternative steps as permitted by Regulations; ii. refer the allegation to the Standards Board for England; iii. decide that no action should be taken in respect of the allegation; or iv. consider that the matters raised are not within the jurisdiction of the Sub-Committee
Any complaints received by the Monitoring Officer to be circulated separately. Minutes:
COMPLAINT 8
Summary: That the complaint stated that a debt was owed by a Member to a third party and that this may bring the Authority into disrepute.
Decision: (1) That it was appropriate for the Sub-Committee to consider this matter even though it was raised anonymously.
REASON: Although the complaint was anonymous, in accordance with Section 57A of the Local Government Act 2000 (as amended), it had been delivered in writing and made an allegation as to breach of a particular paragraph of the Code of Conduct by a Member .
(2) That No Action be taken on the allegation.
REASON: There was no evidence of any connection to the official capacity of the authority, or of the Member, in relation to the allegation. In the absence of any such connection, a breach of the Code of Conduct could not arise.
