Officer’s recommendation: PERMISSION, subject to a Grampian condition
Minutes: The application be APPROVED subject to the conditions and informatives set out in the officer’s report and the below addendum, and subject to a Grampian condition.
The Committee agreed that a representation be made to the Cabinet Member for Environment that the land which was being returned to the Parks and Open Spaces Department be designated as Public Open Space as part of the Local Development Framework process.
The Development Control Officer agreed to provide feedback to the Council’s Property Department on the Committee’s request that the property division consult with neighbours, with regard to future development at the site.
[The Development Control Officer reported that there remained outstanding issues to be resolved in respect of bats. Accordingly the recommendation was amended to:
‘Permission subject to further bat surveys. If the surveys are satisfactory and the bat issue can be resolved the decision is delegated to the Development Control Manager. If the bat issue cannot be adequately resolved the application will be referred back to the Committee for determination.’

Officer’s recommendation: PERMISSION Minutes: The application be DEFERRED for the following reason:
· To conduct a site visit in order to determine whether there would be a harmful effect if the conditions were removed. This site visit must allow Members to view the level of light pollution from the ground floor outside the application site and from the first floor of a neighbouring property.

09/2462/FUL - 5 ELLERAY ROAD, TEDDINGTON Demolition of existing cottage/bungalow and construction of two new semi detached houses.
Officer’s recommendation: PERMISSION Minutes: (1) The recommendation be NOT adopted
(2) The application be REFUSED for the following reason:
The proposed development, by reason of its siting, scale, bulk and mass, would represent a cramped and overbearing development, that would have an unneighbourly and unduly adverse impact on the amenities of no. 8 Dells Close. This being contrary to policies BLT 11 and 16 of the London Borough of Richmond upon Thames Unitary Development Plan First Review Adopted March 2005; policy CP 7 of the London Borough of Richmond upon Thames Approved Core Strategy 2009; and Supplementary Planning Guidance Document ‘Small and Medium Sized Housing Sites’, adopted February 2006.
[The Development Control Officer made the following additions and amendments to the report:
Paragraph 2: ‘pair of two storey, two bed houses’ corrected to read ‘pair of two storey, one bedroom houses.’
Paragraph 5 amended to include: ‘Letters reiterating objections previously made have been received from six properties in Elleray Road and two in Dells Close. The main issues, reported on the agenda, are loss of light and privacy, parking/traffic impact, appearance, overdevelopment and loss of greenery.’
Paragraph 7: ‘the baseline figure for a two-bed house is 65 sqm and each house is just below this figure’ corrected to read ‘the baseline figure for one-bedroomed houses is 45 sqm and each house is in excess of this figure.’
Condition BD12 amended to omit ‘including terrace screen.’
Condition DV15 amended to included ‘first floor windows in side elevation.’
Additional Conditions:
‘No additional windows’: Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no window other than those shown on the approved plan(s) shall be installed in the wall(s) of the building hereby permitted. REASON: To safeguard the amenities of adjoining occupiers.
‘Details of Air Source Heat Pumps/Solar Panels’ Prior to the development commencing, details of the proposed Air Heat Pump units and Solar/Photovoltaic Panels (including size, positioning and form) shall be submitted to and approved in writing by the Local Planning Authority, and such details approved shall be installed prior to the occupation of any of the units. REASON: To ensure that the reduction in co2 emissions is achieved and that the units do not have a detrimental impact on the amenity of adjoining occupiers or appearance of the area.
