Section 106 Agreement

Minutes:

The application be approved subject to completion of a S.106 agreement and subject to the conditions and informatives as set out in the officer’s report and subject to the following condition:

 

·         NS03

No development shall take place, including any works of demolition, until a construction method statement has been submitted to, and approved in writing by the LPA. The approved statement shall be adhered to throughout the construction period. The statement shall provide for:

i)        size and routing of construction vehicles and holding areas for these on site;

ii)       the parking of vehicles of site operatives and visitors;

iii)     the loading and unloading of plant and materials;

iv)     the storage of plant and materials used in constructing the development;

v)      the erection and maintenance of security hoarding;

vi)     measures to control the emission of dust and dirt during construction;

 

·         The Committee agreed that the S.106 agreement should also cover the requirement for the rental of parking spaces not taken up by occupants of the development to be made available to nearby residents.

 

[It was noted that members of the Committee have visited the planning application site.

 

The Development Control Officer made the following additions and amendments to the report:

 

  • New paragraph 45a after para 45; ‘The site lies within an area poorly provided with public open space [CP10 refers]. However as the site is already developed the proposal will have a neutral impact on that policy which generally seeks to make better use of existing open space provision.’
  • Amend condition NS02 by deleting ‘6’ twice & insert ‘4’ twice.
  • Add condition DV44-Code of Sustainable Development Code 4
  • The Teddington Society, whilst recognising the need for affordable housing, argues this area needs more open space of which it is deficient; garages should be re-provided; this & other developments will cause on-street parking problems coupled with more difficult traffic flows; two residents re-iterate strong objection on traffic grounds & highway safety; loss of parking. A resident has submitted further information to justify refusing the scheme on loss of parking.

Demolition of existing house and rebuild of a residential house with a one bedroom flat on the lower ground floor.

[The Development Control Officer made the following additions to the report:

 

Insert after para. 40:

·         The Council’s Arboricultural officer has considered the scheme and assessed impact on the trees.  The only significant trees are at the rear of the house, those being the horse chestnut at 32, a sycamore within the rear of the site itself, and a copper beech at number 34.  These are all worthy of retention and should be suitably protected during the demolition and construction phases.   Therefore prior to the commencement of development and the demolition of the existing property a plan should be submitted plotting these trees, their root protection areas, protective fencing.  With such and other safeguarding conditions, no objection is raised to the impact on these trees.  The proposal will result in the loss of a bay and a cypress to the rear of the property to which no objection is raised, although this should be replaced with at least one tree at the front of the property of a domestic scale.  This can be secured by condition.

 

Additional conditions:

LA01 – Location of trees on and adjacent development sits

The Development Control Officer reported receipt of two letters as follows:

 

a)  One late letter from Mr and Mrs Chilcott containing the following points:

·         Disruption, inconvenience, and danger to surrounding properties from the construction process.

·         Density of building in a single residence street

·         Not genuine need for second dwelling

·         Basement – impact on the water table and drainage

·         Basement could threaten the structural stability of the surrounding properties

·         Access for second property in energy

·         Loss of light

·         Traffic and parking implementation

·         Enforceability of the car club

 

The Local Planning Authority has been copied into letters from Mr and Mrs Chilcott to the Environment Agency, London Fire Service, and Chief Inspector for community and policy.

 

b)  Letter from Paul Brookes Architects containing the following points:

·         A site investigation was carried out to establish the presence of ground water, together with soil and neighbouring structural foundation conditions. 

·         From the site investigation we have carried out and from experience of forming a basement at no. 32 Montague Road we can confirm that there is no ground water within the zone of the proposed basement.  The geology of the site is primarily London Clay and the Clay is essentially an impermeable layer in which ground water will not pass readily.  For this reason we do not see that any variation in ground water level will result for the proposed basement.  In addition, the Royal Borough of Kensington and Chelsea recently commissioned a study into subterranean developments which states, “with regard to the impact of subterranean  ...  view the full minutes text for item 6g
