APPLICATIONS FOR DEVELOPMENT PERMISSION; LISTED BUILDING CONSENT; AND ENFORCEMENT OF PLANNING CONTROL Reports of the Development Control Manager attached – see list below.
The recommendations contained in the attached reports are those of the officers and are not binding upon the Committee.
The Chairman will confirm the order in which the attached reports are to be heard at the start of the meeting. Members are asked to note that there may be an adjournment of the meeting for a period of approximately 10 minutes starting at a convenient time from 8.30pm. |

Replacement of timber casement windows with aluminium casement windows. Replacement of timber framed patio doors with aluminium framed doors.
Officer’s recommendation: PERMISSION Minutes: The Development Control Officer introduced the item and reported the receipt of one additional representation withdrawing an earlier objection to the scheme on the basis of the applicant’s agreement to let residents choose whether or not to have transom bars installed on their ground floor sitting room windows
The Development Control Officer made the following amendment and addition to the report:
· “Amend condition NS03: Prior to the commencement of development a scheme showing the location of existing and proposed obscure glazed windows, and a sample of the obscure glazing, shall be submitted to and approved in writing by the Local Planning Authority. The development shall be implemented in accordance with the approved details. Reason: To ensure the scheme preserves the character and appearance of the site and area, and amenities of nearby occupants.”
· “Add condition: Prior to the commencement of the works hereby approved, detailed drawings shall be submitted to and approved in writing by the Local Planning Authority, showing the existing and proposed windows in front, side and rear elevations (where applicable) of the following properties: 5-15 Park Hill (odd); 17-27 Park Hill (odd); 29-39 Park Hill (odd); 43-53 Park Hill (odd); 55-65 Park Hill (odd) and 67-77 Park Hill (odd). The works shall be carried out not other than in accordance with the approved details. REASON: To ensure that the proposed development does not prejudice the appearance of the locality.”
Councillor Fleming spoke as an interested Councillor.
The Committee considered the information provided by the officer and points raised by speakers. In particular, the Committee noted the following:
· The housing association submitting the application had agreed to let individual tenants elect to have transom bars installed in front of their windows. · The area had a distinct character, accentuated by an adopted colour scheme for specific areas of the estate.
It was RESOLVED:
That the application be APPROVED subject to the conditions and informatives set out in the officer’s report and the following additional condition and informative:
· “Condition U39287 - Blue windows finish: The existing windows and doors that are currently finished in a blue colour and are to be replaced with aluminium, shall not be finished other than in a blue colour that matches the existing, and that shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. REASON: To preserve the architectural character of the site and area in general.” · “Informative – The applicants are encouraged to carry out consultation between tenants in individual properties and the landlord on whether the resident would want transom bars installed.” |

10/2991/FUL - 17A TOWER ROAD, TWICKENHAM (Mr Evans for Miss Soltani) Demolition of the existing bungalow for the construction of two residential dwellings.
Officer’s recommendation: PERMISSION subject to S.106 agreement and implementation of Traffic Management Order Minutes: The Development Control Officer introduced the item and reported the receipt of revised drawings showing the replacement of the glass balustrade around the basement’s light well with a horizontal grill.
The Development Control Officer made the following amendment to the report:
· Amend condition “DV48: Approved drawings: Insert: p_001B, p_002 B, p_003B, p-004B, p_005Ap_006A, p_009B, p_011 B, p_012B, p_013B received on 12 October 2010 and p_010 Rev. C, -_014 Rev. B and p_015 Rev. B received on 23 March 2011.”
The committee heard a representation against the application by Mr Vikram Bhatia and a representation in favour of the application by Mr M W Evans.
The committee noted the concerns raised by neighbours, although many were building control matters. The committee also considered concerns about neighbouring amenity, overlooking and external amenity space although it did not feel this was a sufficient reason to refuse the application.
It was RESOLVED that the application be APPROVED subject to the conditions and informatives set out in the officer’s report. |

10/3627/FUL - 130 ST LEONARDS ROAD, EAST SHEEN (Mr A Horder) Erection of a detached single storey garage with garden room to rear, amendment to permission 05/2295/HOT.
Officer’s recommendation: PERMISSION Minutes: The Development Control Officer introduced the item and reported the receipt of additional correspondence from the Mortlake with East Sheen Society, which raised the following concerns about:
· The development being used as a separate residence · Future impact on the character of The Byeway if 126 and 132 submitted similar applications. · A loss of amenity, traffic problems, loss of back garden land and overdevelopment. · A lack of conditions to ensure the building was used for ancillary accommodation or the parking of a vehicle only
The committee noted the concerns raised by neighbours but felt that they could not prove there would be any demonstrable harm resulting from the development.
It was RESOLVED that the application be APPROVED subject to the conditions and informatives set out in the officer’s report. |

11/0314/VRC - 57 YORK STREET, TWICKENHAM (Mrs A Dean) Variation of condition U36138:
“The use hereby approved shall not operate before 09.00 hours or after 19.00 hours Monday to Friday (inclusive) and before 09.00 hours or after 18.00 hours on Saturday, and the premises shall not be used for the use approved at any time on Sundays and Bank or other Public Holidays. A notice to this effect shall be displayed at all times on the premises so as to be visible from outside.
REASON: To protect the amenity of occupiers of nearby properties and to ensure the development does not prejudice the free flow of traffic and highway and pedestrian safety.“
Officer’s recommendation: PERMISSION Minutes: Councillor Chappell declared that she had predetermined her view on this application. She undertook to withdraw from the Committee for the duration of this item.
The Development Control Officer reported receipt of two further representations from Councillors:
· Cllr Salvoni – The premises had not been trading since permission, there was no change in circumstances to justify the increased hours and an objection had been received. · Cllr Naylor – The hours of operation should be limited to the early evening.
The committee considered the various objections but felt that the increased sound insulation would be sufficient to mitigate these.
It was RESOLVED that the application be APPROVED subject to the conditions and informatives set out in the officer’s report. |
