APPOINTMENT OF CHAIRMAN

    To confirm that Ms Janet Fraser will chair this meeting of the Assessment Sub-committee.

    Ms Janet Fraser was confirmed as the Chairman for the meeting.

DECLARATIONS OF INTEREST

    Members are asked to declare any interests in matters for consideration at the meeting.

    There were no declarations of interest. 

     

    For clarification Councillor Elengorn advised that the complainant was known to him as a fellow candidate in the Local Election of May 2010. Councillor Elengorn also stated that he was a member of the Planning Committee but that he had taken advice and did not consider that either of these matters were declarable interests.

CONSIDERATION OF ANY ALLEGATIONS THAT A MEMBER OF THE COUNCIL HAS
BREACHED THE CODE OF CONDUCT pdf icon PDF 90 KB

    The Committee will assess any allegations that a member of the Authority has failed, or may have failed, to comply with the Code of Conduct and either:

     

    i. Refer the allegation to the Monitoring Officer, with an instruction that he arrange a formal investigation of the allegation, or direct that he arrange training, conciliation or such appropriate alternative steps as permitted by Regulations;

    ii. Refer the allegation to the Standards Board for England;

    iii. Decide that no action should be taken in respect of the allegation;

    or

    iv. Consider that the matters raised are not within the jurisdiction of the sub-committee.

     

    The criteria which the Committee will use to assist it in making the assessment are attached. Any complaints received by the Monitoring Officer are circulated to Members of the Committee only.

    A complaint had been received alleging a breach of paragraphs 5, 10 and 12 of the Members’ Code of Conduct and that the councillors concerned had predetermined their views on an item before the Planning Committee of the Authority.

     

    RESOLVED that the complaint be not referred for further investigation or determination and be rejected as detailed on the attached Decision Notice.

     

    REASONS:

     

    1.  No evidence of predetermination by Councillors A, B, C and D on the basis of the paper submitted.

     

    2.  The Sub-committee will not normally refer for investigation a complaint that would be better dealt with by another forum which in this case would be the planning appeals process or the courts (See “Criteria for Standards Assessment Sub-Committee when making Its initial Assessment Of Members’ Code Complaints – Local Tests to be applied once initial (Standards For England) Tests have been applied” Version 1a (March 2010 with minor revision November 2010 and November 2011)).
