Richmond Council has decided not to contest an appeal to the First-tier Tribunal (Local Government Standards in England) handed down to former councillor Marc Cranfield-Adams in June this year by the Upper Tribunal (Administrative Appeals Chamber).
Permission to appeal was granted following a finding of an error in law by the First Tier Tribunal Principal Judge and on the grounds that Mr Cranfield-Adams had an arguable case with a reasonable prospect of success of showing that he did not breach the Code of Conduct in relation to an allegation of bullying and/or showing disrespect to Officers.
Mr Cranfield-Adams appealed a decision of the Council's Standards Sub-Committee in January 2010. Details of the Standards Sub-Committee decision were released to the press before the former councillor had received a copy.
Gillian Norton, the Chief Executive, apologised to Mr Cranfield-Adams at the time, as the public notice was also inaccurate.
The Chief Executive has re-iterated those apologies saying "it was extremely regrettable that the press were informed before Mr Cranfield-Adams and on the Council’s behalf I apologised then and do so again regarding this error and for any damage to his professional reputation."
